NEW: For the first time, we’re hearing directly from the defense attorney representing the Washington state man accused of throwing a rock toward an endangered Hawaiian monk seal off Maui.

Attorney Myles Breiner says his client, Igor Lytvynchuk, plans to plead not guilty later this month and claims the incident has been widely misunderstood.

Breiner says Lytvynchuk believed he was trying to protect nearby sea turtles from what he thought was an aggressive marine animal, comparing his past experiences with sea lions while living and fishing in Washington state. The attorney says his client did not know Hawaiian monk seals are endangered.

“When I first saw that, like anyone else, I was outraged,” Breiner told me. “But when I learned what was going on and saw the picture of the adult turtles that were in the area, I have a different opinion.”

Federal investigators say the rock narrowly missed the monk seal known as “Lani,” leading to federal misdemeanor charges under the Endangered Species Act and Marine Mammal Protection Act.

Breiner says his client now recognizes it “was a mistake” and “feels guilty for doing that.”

Lytvynchuk is expected back in federal court in Honolulu later this month.
